Welcome to Alchemy Farms. These Terms of Service govern your access to and use of our website and services. By using our site or purchasing products (farm produce, meats, subscription boxes, or farm tours) you agree to these terms. If you do not accept these Terms, please do not use our site. We operate exclusively in Barbados, and any use of the site or purchase is subject to Barbadian law and jurisdiction.

Eligibility and Account Use

  • Age Requirement: You must be at least 16 years old to place orders on our site. Users under 18 (or under the age of majority) are required to have the permission of a parent or legal guardian to make purchases. In particular, minors may browse and use the site only with parental consent (Barbados treats persons under 18 as minors for contracts). This ensures our Terms remain legally binding for younger users. (Users under 13 are not permitted to submit personal data in compliance with child privacy rules.)
  • Barbados Residency: We deliver and sell only within Barbados. By ordering, you confirm you are a resident of Barbados. We reserve the right to refuse or cancel any orders that appear to originate outside our service area.
  • Account Security: If you create an account, you must provide accurate information and keep your login credentials secure. You are responsible for any activity on your account, so use a strong, unique password and notify us immediately of any unauthorized use.

Orders, Pricing and Payment

  • Order Acceptance: All orders are subject to acceptance. We may refuse or cancel any order for any reason (for example, if a product is unavailable, if we suspect fraud, or if order limits are exceeded) without liability.
  • Prices and Changes: All prices listed on our site are quoted in Barbadian dollars and include VAT if applicable. Prices are subject to change without notice and we are not liable for price changes or errors. The final price charged will be confirmed in your order.
  • Payment: We accept payment by credit/debit card or cryptocurrency. Credit card transactions are handled through PCI-compliant payment gateways; Alchemy Farms does not store your full card details. For crypto payments (e.g. Bitcoin, Ethereum), your payment is recorded on the public blockchain. While crypto transactions are pseudonymous, please understand that wallet addresses are public. We will only receive confirmation that the payment was made, not your private payment information.
  • Taxes and Fees: Any applicable sales taxes or fees (such as shipping and handling) will be displayed at checkout. You are responsible for any duties or taxes if you arrange a local pickup.

Shipping and Delivery

  • Delivery Area: We ship only within Barbados. We aim to deliver perishable goods promptly in refrigerated conditions. Risk of loss passes to you upon handoff to our delivery agent (or pickup by you). We are not liable for delays or spoilage once the order has left our farm or facility.
  • Delivery Schedule: Delivery dates and times are estimates. We are not responsible for delays due to weather, traffic, or events beyond our control.

Product Descriptions and Disclaimers

  • Accuracy: We attempt to describe products (vegetables, meats, eggs, subscription boxes) and display images as accurately as possible. However, we do not guarantee that descriptions, images, or colors will be perfectly accurate. Your monitor or device may display colors differently, and seasonal variations in farm produce can occur. Use product information as a general guide only.
  • Product Availability: We may limit quantities available to any customer, household, or region. We reserve the right to modify or discontinue any product or service at any time without notice. We are not liable if we make changes to products, prices, or the availability of our services.
  • Perishable Goods: Our fresh produce and many items are perishable and require refrigeration. We cannot guarantee the shelf-life after delivery; please handle and store perishable items (e.g. vegetables, meat) promptly. We are not responsible for spoilage due to delays in delivery or improper storage by you.
  • Non-perishable Items: For any non-perishable products we sell (for example, packaged goods, farm equipment, or merchandise), we may offer a limited warranty or guarantee as specified on the product. Any such warranty is in lieu of all other warranties. Unless expressly stated, all products are provided “AS IS” with no additional guarantees. We do not manufacture most items and therefore do not offer implied warranties on them. In short, we make no promises about product suitability or durability beyond what is expressly stated.
  • Quality Disclaimer: We do not warrant that product quality will meet your expectations, nor that any errors or defects will be corrected. You use our products and services at your own risk. Our liability, if any, is limited to the amount you paid for the product.

Returns, Refunds and Exchanges

  • Perishable Items: Because of their nature, fresh produce and other perishable items cannot be returned or exchanged. Refunds on perishable goods will only be issued if the product was wrong or defective and the fault is ours (for example, we delivered the wrong item or a spoiled product). If that occurs, please notify us within 24 hours of delivery (with photos if possible) for a refund or replacement.
  • Non-Perishable Items: If you order a non-perishable item and it arrives defective or the wrong item, please contact us within 7 days. We will arrange a refund or replacement as appropriate. Non-perishable items must be returned unused and in original condition. (Customers are generally responsible for return shipping, unless the error was ours.)
  • No Other Refunds: All sales are final except as stated above. We do not offer refunds or exchanges for buyer’s remorse, shipping delays, or damage caused by factors beyond our control. This policy is part of our fundamental selling terms.

User Content and Comments

  • Blog Comments & Reviews: We welcome comments on our blog and product reviews, but all user submissions are the views of the author, not Alchemy Farms. By submitting comments or reviews, you grant us a license to use your content (for example, we may feature a review on our site).
  • Responsibility: You are solely responsible for any content you post (comments, reviews, messages). You agree that your submissions will not violate any third-party rights or laws, and you will not post offensive, defamatory, or illegal content. We reserve the right to edit or remove any content that, in our discretion, violates these rules or is otherwise objectionable.
  • Liability: We take no responsibility for any statements, advice, or opinions made by users in comments or reviews. We do not endorse or guarantee any user content. If you encounter any user content that concerns you, please contact us for assistance.

Intellectual Property

All content on the Alchemy Farms site – including text, graphics, logos, images, and code – is our property or licensed to us, and is protected by copyright and trademark laws. You may not copy, distribute, modify, or create derivative works from our content without our written permission, except that you may download or print a single copy of pages for your personal use (for example, for viewing recipes or storing ordering information).

Limitation of Liability and Disclaimers

  • No Warranty: Except where required by law, we disclaim all warranties of any kind. We provide our website and services “as is” and “as available”. You agree that we make no express promises about the reliability, security, or accuracy of the site or your orders.
  • Limitation of Liability: To the fullest extent permitted by law, Alchemy Farms and its affiliates will not be liable for any indirect, incidental, special or consequential damages (including lost profits or data) arising out of your use of our site or products. Our total liability for any claim will not exceed the price you paid for the product in question.
  • Third-Party Links: Our site may link to third-party websites or social media. We are not responsible for their content or practices. Visiting any external link is at your own risk, and their terms and privacy policy will apply.

Governing Law

These Terms are governed by the laws of Barbados. Any dispute arising under or relating to these Terms will be subject to the exclusive jurisdiction of the courts of Barbados. You agree to comply with all local laws regarding online conduct and acceptable content.

Changes to These Terms

We may update these Terms from time to time (for example, to reflect changes in our business or legal requirements). We will post the revised Terms on this page with a new “Last Updated” date. By continuing to use our site after changes are posted, you accept the updated Terms.
